1. Our Services

Evercrest Publishing provides full-service book publishing solutions, including but not limited to:

• Ghostwriting: Fiction (including fantasy, science fiction, thriller, romance, literary fiction, mystery, horror, and historical fiction), biography and memoirs, non-fiction, children's books, and comic books
• Editing: Manuscript critique, developmental editing, line editing, copyediting, proofreading, and translation
• Book Cosver Design: Custom, genre-specific cover design for print and digital formats
• Publishing: Amazon KDP setup, e-book formatting, print-on-demand, ISBN registration, and global distribution to 40+ retail platforms
• Book Marketing: Amazon marketing, social media campaigns, SEO, email marketing, author website development, and video trailers
• Audiobook Production: Full audiobook recording, editing, and distribution.
• Author Opportunities: Representation at book festivals, literary fairs, and signing events across the United States

Specific deliverables, timelines, and pricing for each project are confirmed in a separate written agreement or proposal prior to commencement of work.

2. Engagement & Payment

• All projects are initiated upon receipt of a signed agreement and the agreed deposit or full payment, as specified in your project proposal.
• Payment schedules, milestone payments, and final payment terms are outlined in your individual project agreement.
• Evercrest Publishing reserves the right to pause or suspend work on a project in the event of non-payment or significant delay in payment.
• All fees are non-refundable once work has commenced, except as expressly stated in your project agreement or required by applicable law.
• Any additional work requested beyond the original project scope may be subject to additional fees and must be agreed upon in writing.

3. Intellectual Property & Ownership

• Upon receipt of full payment, all creative work produced by Evercrest Publishing for your project — including written manuscripts, book cover designs, and marketing materials — is transferred to you as the client. You retain full ownership and all rights to publish, distribute, and monetize the work.
• Evercrest Publishing retains no rights to your finished work and will not publish, reproduce, or claim authorship of any deliverable without your explicit written consent.
• You represent and warrant that any materials, ideas, or source content you provide to us do not infringe upon any third-party intellectual property rights.
• Evercrest Publishing may, with your permission, reference your published book in our portfolio, testimonials, or marketing materials.

4. Client Responsibilities

• You agree to provide accurate, complete information when submitting project inquiries or entering into a service agreement.
• You are responsible for providing timely feedback, approvals, and any source materials required for your project. Delays caused by the client may affect agreed timelines.
• You agree not to use our services to produce content that is defamatory, illegal, plagiarized, or in violation of any third party's rights.
• You are solely responsible for ensuring your published book complies with all applicable laws, including copyright, defamation, and platform-specific content policies.

5. Confidentiality

Both parties agree to keep all project-related information, communications, and unpublished creative materials strictly confidential. Evercrest Publishing will not disclose your manuscript, project details, or personal information to any third party except as required to fulfill your project or as required by law. This obligation survives the termination of any service agreement.

6. Revisions & Approvals

• The number of included revisions for each service (writing, design, editing, etc.) is specified in your individual project agreement.
• Revision requests must be submitted within the timeframe specified in your agreement. Requests submitted after final approval may be treated as new scope and subject to additional fees.
• Final approval by the client constitutes acceptance of the deliverable. Evercrest Publishing is not liable for errors approved by the client.

7. Limitation of Liability

To the fullest extent permitted by applicable law, Evercrest Publishing shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of our services, including but not limited to loss of revenue, loss of profits, or failure to achieve expected book sales or marketing outcomes.

Our total liability for any claim arising from a specific project shall not exceed the total fees paid by you for that project.

8. Website Use

• The content on evercrestpublishing.com — including text, images, logos, and service descriptions — is the property of Evercrest Publishing and may not be reproduced without our written consent.
• We reserve the right to modify, suspend, or discontinue any part of the website at any time without notice.
• We are not responsible for the content of any external websites linked from our site.

9. Governing Law

These Terms are governed by the laws of the State of New York, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of New York.

10. Changes to These Terms

We may update these Terms from time to time. Any changes will be posted on this page with an updated revision date. Your continued use of our website or services after changes are posted constitutes your acceptance of the updated Terms.
